The hiking trail in question, also known as the Sattnitz hill hiking trail, stretches for almost 14 kilometers in the picturesque Spitnikteiche nature reserve. According to the Alpine Club, the tour lasts around 4.5 hours and covers around 550 meters in altitude - a real challenge that attracts many hikers. However, visitors are increasingly faced with the barrier, which not only blocks the path but also disrupts the natural movement of wildlife.
Legal basis of freedom of way
In Carinthia, the law on freedom of movement in the mountains, which came into force on March 22, 1922, supports hikers. This law states that paths and paths that are important for tourist traffic may not be closed without further ado. Private paths must be opened with reasonable compensation and markings and signposts must be tolerated. It is clear: every hiker has the right to move even on marked trails and a permanent closure is not permitted, except in certain exceptional cases regulated by law, such as Alpine Club points out.
The property owner of the area has not yet commented on the allegations, but plans to speak with city officials. It is important to clarify whether the fence actually adheres to all the required distance regulations from the road, which is necessary in terms of safety and access for hikers.
The community has a duty
The city of Klagenfurt and the responsible authorities are now required to address the situation. According to legal provisions, the district administrative authority is responsible for monitoring compliance with the right of way. In this way, consultation with the owners could not only provide clarity, but also help hikers to soon be able to enjoy their route without obstacles again.
