Commerzialbank: Expert opinion reveals insolvency since 1999!
The current situation around Commerzialbank Mattersburg is more than explosive. A comprehensive report by Karl Hengstberger has now shown a dark picture of the bank's financial situation. According to the investigation, the Commerzialbank was insolvent at the latest in 1999, long before the banking operation was stopped. The report, which includes almost 600 pages, analyzes the events to this critical point and shows that the bank was not entitled to run banking transactions. This is evident from a report by the Kleine Zeitung.
The Commerzialbank was founded in 1996 by Martin Pucher. According to the report, he and the co-officer Franziska Klikovits would have had to recognize the bank's insolvency due to their knowledge of balance sheet manipulations. In the 20 years after the foundation, around 2.9 billion euros flowed to 766 deposit accounts. Nevertheless, loans of 86.4 million euros were awarded to customers and close people who were not economically justifiable. It is particularly striking that 31.2 million euros of these loans went to companies, the Puchers football club SV Mattersburg sponsors.unexplained financial flows and excessive board members
The knowledge from the expert opinion also show that the bank did not exists in its balance sheets to customers and credit institutions, which, according to the 2018 annual financial statements, added up to over 570 million euros. This raises serious questions about the financial practices. In this context, Hengstberger identified drainage of around 71 million euros from a non -real money cycle - a clear indication of possible falsification of balance sheet. In the economy, this is seen as a serious offense that can be punished in Austria in accordance with Section 163a of the Criminal Code, since essential information has been illustrated incorrectly or incomplete. An overview of the counterfeits and their consequences can be found on Wikipedia.
Another critical point are the high board covers, which were a total of 11.6 million euros gross for the years 2008 to 2020. These added up and were rated by Hengstberger as inappropriate in comparison to the size of the bank - with only nine locations and 74 employees. In addition, there are the exorbitant payments to consules, such as the salary of 12,000 euros per month, which has been awarded to an alleged judge teacher, from which a total of 420,000 euros add up. That only makes the entire situation more questionable.
outlook and upcoming negotiation dates
The affair also has legal consequences. The next negotiation will take place on July 17th at the Eisenstadt regional court. Two entrepreneurs must be responsible for "mutual granting of loan funds". This negotiation could be the last in the current process and is eagerly awaited because it could significantly lead to clarifying responsibilities.
The Commerzialbank plans were not only significantly influenced by internal failure, but also by the complex interaction with Martin Pucher's football club's sponsorship policy. These entanglements throw a shadow on the future of the bank and the integrity of the financial system in the region. The discussion about counterfeits and their consequences will probably be busy for a long time, and it will be interesting to see how the legal disputes will develop.
